TERMS & CONDITIONS

1. DEFINITIONS
In these Terms and Conditions:
- "Service" refers to yacht charter experiences provided by Horizonte
- "We," "us," "our," and "Horizonte" refer to the yacht charter operator based in Phuket, Thailand
- "You," "your," and "Guest" refer to the person or entity booking or participating in our services
- "Charter" or "Voyage" refers to the specific yacht rental and associated maritime experience
- "Agreement" refers to these Terms and Conditions along with any booking confirmation
- "Vessel" refers to the yacht or boat provided for the charter
2. ACCEPTANCE OF TERMS
By booking a charter, submitting an inquiry, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not proceed with booking.
You must be at least 18 years of age to enter into this agreement. If booking on behalf of a group, you confirm that you have authority to bind all participants to these terms and that all participants meet age requirements.
3. SERVICE DESCRIPTION
Horizonte provides yacht charter services in Phuket waters and surrounding areas of the Andaman Sea. Our services include vessel rental, professional crew, and maritime experiences as described in our voyage types: Horizon Watch Cruise, Panorama Day Experience, and Open Water Odyssey.
All descriptions, itineraries, and voyage details are provided in good faith but are subject to variation due to weather conditions, sea state, safety considerations, or circumstances beyond our reasonable control. We reserve the right to make reasonable modifications to ensure guest safety and service quality.
4. BOOKING AND CONFIRMATION
4.1 Booking Process
To book a charter, you must contact us via phone, email, or our website contact form. We will discuss availability, preferences, and provide pricing information. A formal booking is established upon our written confirmation and receipt of the required deposit.
4.2 Pricing
All prices are quoted in Thai Baht (THB) and include vessel rental, crew services, fuel for the planned itinerary, and inclusions as specified in the voyage description. Prices do not include gratuities, alcoholic beverages beyond those included, special dietary requests requiring additional provisions, or activities not specified in the standard itinerary.
4.3 Payment Terms
Payment schedule is as follows:
- 50% deposit required within 7 days of booking confirmation to secure the charter
- Remaining 50% balance due 14 days prior to charter date
- For bookings made less than 14 days before charter date, full payment is required immediately
Accepted payment methods include bank transfer, credit card (subject to processing fees), and other methods as agreed. Booking is not confirmed until deposit is received and confirmed by us.
5. CANCELLATION AND REFUND POLICY
5.1 Cancellation by Guest
Cancellation refunds are calculated based on notice provided:
- More than 14 days before charter: Full refund minus 10% administrative fee
- 7-14 days before charter: 50% refund of total charter fee
- Less than 7 days before charter: No refund available
All cancellations must be submitted in writing via email to be valid. The cancellation date is the date we receive your written notice.
5.2 Cancellation by Horizonte
We reserve the right to cancel a charter due to weather conditions, mechanical issues, safety concerns, or other circumstances beyond our control. In such cases, we will offer to reschedule your charter or provide a full refund. We are not liable for any additional costs you may have incurred (such as travel arrangements).
5.3 Rescheduling
If you need to reschedule your charter, we will make reasonable efforts to accommodate your new dates subject to availability. Rescheduling requests made more than 14 days before the original charter date will incur no fees. Requests made less than 14 days before the charter will be treated as cancellations under our standard policy.
6. GUEST RESPONSIBILITIES
6.1 Conduct
Guests agree to:
- Follow all instructions and directions from the captain and crew
- Respect the vessel, equipment, and other guests
- Refrain from behavior that endangers safety or disrupts the voyage
- Not operate any vessel equipment or machinery without explicit permission
- Comply with all applicable maritime laws and regulations
6.2 Health and Fitness
You confirm that all participants are in adequate health to participate in maritime activities. You must inform us of any medical conditions, disabilities, or special requirements that might affect participation. We reserve the right to refuse service if we determine a guest's condition poses safety risks.
6.3 Prohibited Items and Activities
The following are prohibited on all charters:
- Illegal drugs or substances
- Weapons of any kind
- Excessive alcohol consumption that impairs safety
- Smoking in enclosed areas (smoking permitted in designated outdoor areas only)
- Activities that could damage the vessel or endanger others
Violation of these rules may result in immediate termination of the charter without refund.
7. SAFETY AND WEATHER
The captain maintains absolute authority regarding all safety matters and route decisions. Weather in tropical maritime environments can change rapidly. The captain may modify routes, shorten the voyage, or postpone departure if conditions pose safety concerns.
All guests must participate in the safety briefing before departure and follow emergency procedures if required. Life jackets and safety equipment will be provided and must be used when instructed by crew.
If a charter must be shortened or routes modified due to weather or sea conditions, we will make reasonable efforts to provide comparable experiences. However, no refunds are provided for time lost due to weather conditions encountered during the charter.
8. LIABILITY AND INSURANCE
8.1 Our Insurance
Our vessels carry comprehensive marine liability insurance and crew insurance as required by Thai maritime law. This insurance covers vessel damage and third-party liability arising from our operations.
8.2 Guest Insurance
We strongly recommend that guests obtain travel insurance covering trip cancellation, medical expenses, and personal belongings. Our insurance does not cover guest personal property, medical expenses, or trip interruption costs.
8.3 Limitation of Liability
To the maximum extent permitted by law, Horizonte's liability for any claim arising from our services is limited to the amount paid for the charter. We are not liable for indirect, consequential, or punitive damages, including lost enjoyment, additional travel costs, or other incidental expenses.
8.4 Guest Assumption of Risk
Maritime activities carry inherent risks. By participating in our charters, you acknowledge and accept these risks. We maintain high safety standards, but cannot eliminate all risks associated with boating, swimming, or water activities.
9. DAMAGE AND LOSS
Guests are responsible for any damage to the vessel, equipment, or furnishings caused by their negligence or intentional actions. You agree to reimburse us for repair or replacement costs resulting from such damage.
Horizonte is not responsible for loss or damage to guest personal belongings. We recommend keeping valuables secure and avoiding bringing items of exceptional value on the charter.
10. INTELLECTUAL PROPERTY
All content on our website, promotional materials, and documentation, including text, images, logos, and design elements, are the property of Horizonte or used with permission. You may not reproduce, distribute, or use our content without written authorization.
You grant Horizonte permission to use photographs or videos taken during your charter for promotional purposes unless you specifically opt out in writing before the charter.
11. PRIVACY
We collect and process personal information in accordance with our Privacy Policy. By booking our services, you consent to such collection and processing. Please review our Privacy Policy for detailed information about our data practices.
12. FORCE MAJEURE
We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to severe weather, natural disasters, acts of government, terrorism, civil unrest, pandemics, or other force majeure events. In such cases, we will work with you to reschedule or provide appropriate alternatives.
13. GOVERNING LAW AND JURISDICTION
These Terms and Conditions are governed by the laws of Thailand. Any disputes arising from or relating to these terms or our services shall be subject to the exclusive jurisdiction of the courts in Phuket Province, Thailand.
We encourage resolving any concerns through direct communication with us before pursuing formal dispute resolution. Many issues can be addressed satisfactorily through good-faith discussion.
14. SEVERABILITY
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
15. ENTIRE AGREEMENT
These Terms and Conditions, together with our Privacy Policy and any written booking confirmation, constitute the entire agreement between you and Horizonte regarding your charter. These terms supersede any prior discussions, representations, or agreements.
16. AMENDMENTS
We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on our website with an updated effective date. Bookings made before changes take effect remain subject to the terms in place at the time of booking.
